These Terms and Conditions ("Terms") govern your access to and use of the HiringReferrals platform operated by Akshantre Biztech Consultants Pvt Ltd ("Company", "we", "our"). By registering or using the platform in any capacity — candidate, referral partner, freelancer, employer, recruiter, or accountant user — you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts under the Indian Contract Act, 1872 to use this platform. By registering, you confirm you meet these criteria.
2. Platform Use
The platform facilitates referral-based hiring between candidates, referral partners, freelancers, and employer clients. All users must use the platform only for its intended purposes. Misuse, fraud, impersonation, or scraping of data is strictly prohibited.
3. Candidate Obligations
Candidates must submit accurate, complete, and truthful information. Any misrepresentation of qualifications, experience, or identity will result in immediate disqualification, account suspension, and potential legal action. The Company reserves the right to verify all information submitted.
4. Referral Partner Obligations
Referral partners must obtain explicit consent from candidates before submitting their profiles. Spam referrals, duplicate submissions across multiple accounts, or solicitation of candidates outside the platform are violations. The Company reserves the right to claw back commissions paid on fraudulent referrals.
5. Freelancer Partner Obligations
Freelancers registering on the platform to source and refer candidates must complete KYC verification before any payout is processed. Wallet balances reflect pending, approved, and paid commissions and are subject to the same 91-day employer retention confirmation as other referral partners. Freelancers are solely responsible for their own tax obligations on income earned through the platform; the Company will deduct TDS where legally required.
6. Employer Obligations
Employers must provide timely feedback, initiate BGV within stipulated timelines, and confirm 91-day retention honestly. Ghosting candidates after offer issuance or providing false retention confirmations constitutes a breach of these Terms.
7. Commission & Payout Terms
All commissions are subject to the rate card agreed at employer onboarding. Payouts are subject to BGV clearance, 91-day employer confirmation, and KYC verification of the referral partner or freelancer. TDS will be deducted per applicable Indian Income Tax provisions.
8. Payment Processing
All online payments — including employer invoice settlements and order placements — are processed through Razorpay, a third-party licensed payment gateway. The Company does not store your card, UPI, or net-banking credentials; these are handled directly by Razorpay under its own security and compliance standards. GST-compliant invoices for employer billing are generated and managed by the Company's accounts team.
9. Intellectual Property
All content, branding, software, and algorithms on the platform are the intellectual property of Akshantre Biztech Consultants Pvt Ltd. Unauthorised reproduction, scraping, or copying is prohibited.
10. Limitation of Liability
The Company is not liable for employment outcomes, salary accuracy, employer conduct post-hiring, or technical downtime beyond commercially reasonable measures. The platform is an intermediary and does not guarantee placement outcomes.
11. Communications & Notifications
By registering, you consent to receive transactional and service-related communications — including application updates, interview alerts, and payout notifications — via email, SMS, and WhatsApp (through the WhatsApp Business Platform). You may opt out of non-essential communications at any time through your account settings, though essential service notifications cannot be disabled.
12. Automated & AI-Assisted Processing
The platform uses automated tools, including third-party AI language-model providers, to parse resumes, generate job-match scores, and assist with content suggestions. These outputs are used to assist, not replace, human decision-making in hiring and verification processes.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes arising from platform use shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.
14. Amendments
The Company reserves the right to amend these Terms at any time. Continued use of the platform after amendments constitutes acceptance of the revised Terms.
