1. Employer Health & Safety Requirements

All Employers listing jobs on HiringReferrals must comply with applicable Indian health and safety legislation, including:

• Factories Act, 1948 — applicable to manufacturing and industrial establishments.
• Shops and Commercial Establishments Act — state-specific compliance for office and retail environments.
• Employees' State Insurance (ESI) Act, 1948 — mandatory ESI contributions for eligible employees.
• Employees' Provident Funds (EPF) Act, 1952 — PF compliance for qualifying establishments.
• POSH Act, 2013 — Prevention of Sexual Harassment at Workplace: mandatory Internal Committee, awareness training, and complaint mechanisms.
• Building and Other Construction Workers Act, 1996 — applicable for construction-sector listings.

2. Workplace Safety Declaration

By listing a job on HiringReferrals, Employers declare that:

1. Their workplace complies with all applicable local, state, and central health and safety laws.
2. All mandatory safety equipment, training, and procedures are in place.
3. ESI and EPF registrations (where applicable) are active and compliant.
4. An Internal Complaints Committee (ICC) under POSH Act is constituted and functional.
5. Candidates will not be required to work in conditions that violate Indian labour law.

3. Candidate Rights & Protections

Every candidate placed through HiringReferrals has the right to:

• A written offer letter before joining.
• A safe physical and psychological work environment.
• Statutory benefits (ESI, PF, gratuity) as applicable.

5. High-Risk Industry Additional Requirements

For listings in construction, logistics, manufacturing, and healthcare sectors, HiringReferrals may require additional documentation including safety certifications, accident insurance policies, and site safety inspection reports before approving job listings.

6. Mental Health & Wellbeing

HiringReferrals encourages Employers to maintain psychologically safe workplaces. This includes reasonable working hours, no unpaid overtime, clear role expectations, and accessible grievance mechanisms. We reserve the right to remove listings from Employers with consistent reports of a toxic work environment.
